Back in April, Kesha was denied an appeal against the court ruling that she was Dr. Luke was slandered after the New York Court of Appeal ruled that the producer did not qualify as a “public figure.”
Now, in a new ruling by The Hollywood Reporter, the producer – real name Lukasz Gottwald – must prove that Kesha made her first claim against him with malicious intent. However, new York Supreme Court Justice Jennifer Shektar’s ruling also stated that Kesha had the right to file a counterclaim in Gottwald’s defamation lawsuit.
The lawsuit between the two has been ongoing since 2014 when Kesha Dr. Luca was sued for emotional assault and sexual harassment. Dr. Luca hit back at Kesha, claiming she broke the record contract they had together and made a rape allegation to get out of the deal.
In February 2020, a New York Supreme Court judge ruled that Kesha defamed Gottwald in a text he sent to Lady Gaga, accusing Gottwald of raping Katy Perry, a lawsuit Perry and Gottwald denied.
Later that day, Kesha’s legal team announced that they would immediately appeal the ruling. However, on April 22, the complaint was dismissed, according to The Hollywood Reporter.
According to the latest developments, Gottwald’s attorneys gave Pitchfork their opinion on the decision. Christine Lepera said: “Today’s trial was only about technical legal matters: the burden of proof during the trial. Dr. Luca will take the case apart from the burden of proof.
During the trial, Dr. Luca will prove to the jury, as he always says, that Kesha spread cruel lies to cancel her contract. Kesha refuses to file a lawsuit against Luke for which she bears the burden of proof – because she knows she will lose and she is lying.”
